New Jersey's known as a costly state when it comes to malpractice, and while the state is above average in terms of payouts, there are many states with much higher average awards. In 2011, doctors and hospitals paid $164.5 million in medical malpractice claims, with an average price tag of $383,000, according to statehealthfacts.org, a website sponsored by the Henry J. Kaiser Family Foundation.

There were 429 claims paid out in 2011. Nationally, there were 9,497 claims at an average of $334,559 per claim for a $3.1 billion payout.

Still, there were plenty of states that had far greater sums awarded on average than New Jersey, including Hawaii ($884,474), Idaho ($639,259), Missouri ($631,121), Massachusetts ($616,744), Delaware ($602,762), and Illinois ($584,026) among others. The states with the lowest payouts were Indiana ($134,574), West Virginia ($143,432), and Texas ($171,112).
